Legal Action Predicted on Behalf of Medical Marijuana

Representative Lou Lang hasn't given up on Illinois's medical marijuana bill, which he says he'll submit one last time to the lame-duck house in January (it's already passed the senate), but, to be honest, he didn't sound optimistic.

And Dan Linn, executive director of the Illinois chapter of the National Organization for the Reform of Marijuana Laws, sounds less optimistic. He's already talking about Plan B.

"The chances of that happening in January are slim," says Linn, speaking of passage. "But patients more likely to file suit against the state. We're going to take it to the next level. We’re in the process of talking to people [lawyers] who are willing to do it pro bono. That’s the next move."

The medical marijuana bill went down to defeat in the house December 1, the same day the house passed the civil union bill. What Lang says is possible Linn is certain of — that moderate Republicans in the house couldn't bring themselves to vote for both bills the same day. In fact, says Linn, two Democrats representing conservative districts were told to vote against Lang's bill for their own protection once it was clear their votes wouldn't be enough to pass it.
