      <![CDATA[Better to have to pay back a billion with revenue from the re-possessed parking meters than see what some estimates place between 6-10 billion dollars of revenue fly out the window. This city just closed ~50 schools due to a half-a-billion dollar budget shortfall.

      <![CDATA[If the court agrees it means that the city would have to refund the $1.6 Billion (or whatever it was, though I suppose they might be able to subtract a tiny bit based on last few years when CPM was receiving the money). That money is not easily available, to say the least.

      <![CDATA[@The original IAC: A more relevant analogy would be the City and County refusing to defend the state law prohibiting same sex marriage. Government entities can and do decide whether or not to defend lawsuits based on the merits of the suit.

      <![CDATA[Just to give an analogy, the idea that Emanuel should support the plaintiffs in this lawsuit simply because he agrees with them that the parking meter deal was a bad decision would be a lot like saying that someone who bought a house during the real estate boom whose now in foreclosure shouldn't fight the foreclosure because it would be hypocritical to fight against an action taken against a purchase that he now realizes was a bad idea. That person likely had made statements about how it was stupid to buy the house at the time he did.

I wouldn't exactly phrase it like that. If the city were to take the position that the deal should be struck down because "the city illegally auctioned off its power to set public policy that manages traffic and parking" it would be advocating for something that would have tremendous implications in the future.

      <![CDATA[Everytime I pay a buck-fifty for the privilege of parking for 48 minutes, I have to imagine there's creative ways to fuck with CPM (I tend to agree with Rahm that the lawsuit's going nowhere. Generally he's right that if you want to unwind a contract, we'd have to pay back CPM; and like a teenager on his first payday, we blew through that cash long ago).<br>
